  • LEGAL NOTICE (published in the Lancaster Intelligencer Journal/New Era, December 23, 2011 – Notice of Action Notice is given that the Council of the Borough of Columbia, Lancaster County, Pennsylvania will be holding a public hearing on January 9, 2012, at 7:00 p.m. in Council chambers of the municipal building located at 308 Locust Street, Columbia, 17512, pursuant to the improvement of deteriorating Real property or areas tax exemption act, 72p.s.§4711-01, et seq., to affix the boundaries of deteriorated areas for purposes of tax abatement for properties upon which dwelling units have sustained improvements and will, immediately thereafter or at a meeting to be held within 30 days thereof, consider for adoption two ordinances. The first ordinance is titled and summarized as: “An Ordinance of the Borough of Columbia, Lancaster County, Pennsylvania amending the Code of the Borough of Columbia, Lancaster County, Pennsylvania, pursuant to the Improvement of Deteriorating Real Property or Areas Tax Exemption Act, 72p.s.§4711-101, et seq., affixing the boundaries of deteriorated areas for purposes of tax abatement for improvements as defined in the aforementioned act; providing for the repeal of inconsistent ordinances; providing for the severability of the ordinance; and providing that the ordinance shall take effect as provided by Pennsylvania law.” In summary, this Ordinance, in accordance with the Deteriorating Real Property or Areas Tax Exemption Act, designates and affixes the entire Borough as described in Ordinance No. 640 of the Borough of Columbia as the boundaries of the deteriorated area for purposes of said Act. The second Ordinance is titled and summarized as: “an Ordinance of the Borough of Columbia, Lancaster County, Pennsylvania amending the code of the Borough of Columbia, Lancaster County, Pennsylvania, pursuant to the Improvement of Deteriorating Real Property or Areas Tax Exemption Act, 72p.s.§§4711-101, et seq., defining and authorizing tax exemptions from real property tax for certain improvements to deteriorated dwellings and for improvements of deteriorated areas by the construction of new dwelling units; providing for an exemption schedule, procedures for obtaining exemptions, and determining the termination date hereof for those properties qualifying hereunder located within the Borough of Columbia; providing for the repeal of inconsistent ordinances; providing for the severability of the ordinance; and providing that the ordinance shall take effect as provided by Pennsylvania law. ”Section 1 of this Ordinance establishes definitions for use throughout the Ordinance. Section 2 establishes exemption from real property taxes in accordance with the Improvement of Deteriorating and Real Property Areas Tax Exemption Act with the schedule for exemptions being set forth in Section 3. Section 4 sets forth the procedures for obtaining an exemption while Section 5 sets forth the requirements for amending the Ordinance. The Ordinance also provides for a termination date five years after its effective date, or December 31, 2016, provides for non-permissible exemptions, provides for the repeal of inconsistent ordinances, provides for the severability of the Ordinance and provides that the Ordinance shall become effective in accordance with Pennsylvania law. Copies of both Ordinances may be inspected at the Borough Office located at the Municipal Building, 308 Locust Street, Columbia, PA, and the Lancaster Law Library, during regular business hours.
